Terms and Conditions

Welcome to Hincle! These Terms and Conditions of Use (the “Terms”) govern your access to and use of the Hincle mobile application (the “App”) provided by Hincle, located in Bangalore, India. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

  1. Acceptance of Terms

By creating an account, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, including our Privacy Policy and End User License Agreement (EULA), which is incorporated herein by reference.

  1. Eligibility

You must be of legal age to form a binding contract in India (currently 18 years of age) to use this App. By using the App, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.

  1. Account Registration and Use
  • Registration: To use the App, you will need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Account Security: You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately of any unauthorized access to or use of your account.
  • Responsibility for Activity: You are solely responsible for all activities that occur under your account.
  • One Account Per Person: You agree not to create more than one account.
  1. User Conduct

You agree to use the App in a respectful and lawful manner. You are solely responsible for your interactions with other users. You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Harass, stalk, threaten, or otherwise violate the rights of other users.
  • Post or transmit any content that is defamatory, obscene, pornographic, offensive, hateful, discriminatory, or otherwise inappropriate.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Solicit personal information from minors.
  • Engage in any fraudulent or deceptive activity.
  • Violate any applicable laws or regulations.
  • Attempt to gain unauthorized access to the App or other users’ accounts.
  • Interfere with or disrupt the operation of the App.
  • Use any automated means, including bots, spiders, or scrapers, to access or collect information from the App without our express written permission.  
  • Promote or advertise commercial products or services without our consent.  

We reserve the right to investigate and take appropriate action, including but not limited to terminating your account, if we believe you have violated these Terms.  

  1. Content and Intellectual Property
  • Your Content: You are solely responsible for the photos and other content you post, upload, or otherwise make available on the App (“Your Content”). You represent and warrant that you have all necessary rights to Your Content and that it does not infringe upon the rights of any third party.  
  • License to Your Content: By posting Your Content on the App, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, display, and distribute Your Content in connection with the operation and provision of the App.  
  • Hincle Content: The App and its original content, features, and functionality (including but not limited to text, graphics, logos, and software) are owned by Hincle and are protected by copyright, trademark, and other intellectual property laws. You may not use our content without our express written permission.  
  1. Termination
  • Termination by You: You may terminate your account at any time by following the instructions within the App.
  • Termination by Us: We reserve the right to suspend or terminate your account at any time, with or without cause, and without prior notice or liability to you. Reasons for termination may include, but are not limited to, your breach of these Terms.
  • Effect of Termination: Upon termination of your account, your right to use the App will immediately cease. We may retain Your Content for a period as required by law or our internal policies.  
  1. Disclaimers

THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE CONDUCT OF USERS OF THE APP OR THEIR COMPATIBILITY WITH YOU. YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS.

  1. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HINCLE OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.  

  1. Indemnification

You agree to indemnify, defend, and hold harmless Hincle and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the App; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any rights of another party.  

  1. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Bangalore, India.  

  1. Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes by posting the updated Terms within the App or by other means, such as sending you an email notification. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms. It is your responsibility to review the Terms periodically for any updates.

  1. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hincle regarding your use of the App and supersede all prior or contemporaneous communications and proposals, whether oral or written.  

  1. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.  

  1. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
